Man sentenced for fatal DUI crash that killed his wife

SALMON — A judge has ordered a Salmon man to spend time in jail after a DUI crash killed his wife last year.
Joshua Lee Kion, 30, pleaded guilty to misdemeanor DUI and misdemeanor vehicular manslaughter on March 23. Magistrate Judge Andrew Woolf ordered Kion to serve 43 days in jail, followed by four years of probation. As part of a plea agreement made with prosecutors, his original charges were reduced from felonies to misdemeanors.
Kion’s charges stem from an Oct. 26 crash on U.S Highway 93 that killed Brittany Kion. The couple was in an SUV with Kion driving, according to court documents. When Lemhi County deputies arrived at the scene, they found the SUV overturned. Kion told them he was intoxicated and deputies smelled alcohol on him.

Kion’s wife died at the scene and he was taken to Steele Memorial Hospital. A deputy wrote in a probable cause affidavit that Kion “made additional statements regarding his intoxication at the time of the crash.” Kion also gave a blood sample, but results were not included in court documents.
The judge suspended 300 days of jail time so if Kion is not successful on probation, he could serve additional time. The $2,000 in fines were also suspended, according to court records.
