Man out on bail arrested for kidnapping and other felony charges

IDAHO FALLS — A man out on bail for kidnapping and other charges was arrested Thursday after allegedly taking his children from their mother while pointing a gun at her.
Charging documents show Makena Bret Lagana, 27, went to a home on the 7000 block of South 55th West around 4:30 p.m. The Bonneville County Sheriff’s Office got a call from the woman who lived at the home saying there was a protection order in place preventing Lagana from having contact with her.
In the court documents, she says Lagana went into the home, pulled out a handgun and shoved her face into the ground. Lagana then left the house with his two young children. The civil protection order also says Lagana can not have contact with the children.

As deputies spoke with the woman, investigators discovered multiple previous violations of the no-contact order, which had been in place since March.
The Sheriff’s Office found Lagana’s Cadillac outside the Ross Dress For Less parking lot in Idaho Falls on Hitt Road. As a deputy pulled up, Lagana got out of the car with the children and crouched behind the Cadillac. Deputies convinced Lagana to let both of the kids go and they took him into custody.
A Sheriff’s K9 was brought in and found marijuana, prescription pills, a homemade pipe and pieces of tinfoil used to smoke drugs, and multiple needles. Deputies also found two loaded handguns in a case on the floor by the driver’s seat.

Lagana told deputies he had also eaten a baggie of heroin just before investigators arrived. He was Transported to Idaho Falls Community Hospital before being booked into the Bonneville County Jail.
Bonneville County prosecutors charged Lagana with felony second-degree kidnapping, unlawful possession of a gun by a felon, felony destruction of evidence, felony possession of a controlled substance, misdemeanor domestic battery, two misdemeanor charges of possession of a controlled substance and misdemeanor possession of drug paraphernalia.
Law enforcement is familiar with Lagana not only for the alleged violation of protection orders but for an aggravated assault in Jefferson County. Charging documents in the county Lagana allegedly went to an old neighbors house in March and pointed a revolver at his face, telling him to run. The victim said they thought they were going to die that night.

The Rigby Police Department announced their search for Lagana. Several weeks later, the Idaho Falls Police Department spotted the man and after a brief foot chase, officers took Lagana into custody. He posted $50,000 bail and was released from jail. He pleaded not guilty to the charges in Jefferson County and is scheduled for a jury trial in January.
Although Lagana is accused of crimes, it does not necessarily mean he committed them. Everyone is presumed innocent until proven guilty.
He is scheduled for a preliminary hearing on the new Bonneville County charges on Nov. 5.
