Samuel Brinkerhoff | Bonneville County Jail
IDAHO FALLS — A Utah man police found sleeping next to an ATM will spend time on probation after getting into a scuffle with first responders.
Last week, Samuel Brinkerhoff, 21, pleaded guilty to misdemeanor assault and battery on certain personnel. Magistrate Judge Kent Gauchay placed him on 18 months of supervised probation.
As part of a plea agreement, a felony assault and battery on certain personnel charge was amended to a misdemeanor. A misdemeanor resisting arrested charge was also dismissed by prosecutors.
Gauchay suspended 223 days of a 270-day jail sentence for Brinkerhoff. The man had already spent 43 days in the Bonneville County Jail, which he was given credit for. Officials released him to probation last week.
In November, an Idaho Falls Police officer found Brinkerhoff and a homeless couple sleeping in the ATM structure at the Wells Fargo on A Street. Brinkerhoff initially did not respond to the officer and appeared to be under the influence of drugs or alcohol.

Brinkerhoff then became belligerent and got into a scuffle with several officers. The Idaho Falls Fire Department arrived and as EMS began checking him out, police report Brinkerhoff started yelling and spitting. Officers report they then placed a spit mask over his head.
Police and EMS took Brinkerhoff to Eastern Idaho Regional Medical Center for medical clearance before taking him to the Bonneville County Jail. Officers report Brinkerhoff yelled almost the entire time and would not calm down.
Emergency room staff determined Brinkerhoff had no serious injuries from the scuffle.
The fighting did not stop there. Brinkerhoff is alleged to have resisted jail staff and they had to take him to the ground and place him inside a holding cell to calm down.
