Charge dismissed against man accused of rape

IDAHO FALLS — Rape charges have been dismissed against an Idaho Falls man who allegedly forced an unwanted sex act during a consensual sexual encounter.
Charges against Zachary Paul Hoover were dropped last month by the Bonneville County Prosecutor’s Office.
Deputy Prosecuting Attorney Alayne Bean tells EastIdahoNews.com sufficient evidence had been obtained in the case but she and the victim both decided to dismiss it. The two parties concluded they lacked a “reasonable likelihood” of conviction, Bean said.

Hoover, 29, was accused of forcing anal sex on the victim, who kicked Hoover off of her.
The following day, she spoke with police and was administered a rape kit at Eastern Idaho Regional Medical Center. DNA evidence was obtained linking Hoover to the alleged crime, Bean said.
Hoover apologized to the victim, explaining that what he had done was not something he would normally do. During an interview with police, he admitted to having consumed alcohol.
A no-contact order between Hoover and the victim was issued by the court.
